The Masqar.com platform has been created to mediate between MASQAR’s CUSTOMERS and MASQAR’s registered TRANSLATOR.
Masqar.com is the property of partners (hereinafter referred to as "MASQAR" and "Masqar.com").
The following Terms and Conditions refer to the access, make, use, and services provided by MASQAR, with particular attention to those which are provided by the TRANSLATOR to the Customer using the platform.
By using or accessing the website or its services, translators and customers agree to these Terms and Conditions, along with MASQAR’s Privacy Policy.
If you do not wish to agree to these Terms and Conditions, you should immediately leave the website.
"TRANSLATOR" is any person of legal age and status who has registered as a TRANSLATOR at Masqar.com, intending to provide their localization and interpreting services to Masqar's CUSTOMER.
"CUSTOMER" is any person or company that has registered as a CUSTOMER at Masqar.com, intending to acquire translation services via Masqar.com
"MEETUP" is a type of service in which the TRANSLATOR physically shows up at a location indicated by the CUSTOMER to provide their services.
"ONLINE SERVICES" is a type of service that involves remote translation work via the internet, phone line, or any other form of remote communication.
"CUSTOMER INFORMATION AND DOCUMENT(S)" any information shared by the CUSTOMER with the TRANSLATOR through MASQAR’s platform.
"QUALITY LEVEL" is the result of MASQAR’s evaluation of the final product delivered by the TRANSLATOR to the CUSTOMER.
"PLATFORM" means the online portal, application, and platform of MASQAR that allows TRANSLATORS and CUSTOMERS to access their accounts, contact each other, initiate REQUESTS, manage translation projects, issue and receive payments, and engage into activities regarding the execution of their projects.
"USER" TRANSLATOR and CUSTOMER.
"PRODUCT" means translated content or service provided by the TRANSLATOR to the CUSTOMER.
To use or offer services at MASQAR, USERS must be over 18 years old or the legal age to work in their country. Minors are strictly prohibited from using MASQAR’s Platform. If USERS misrepresent their age or location on their registration process, MASQAR shall have a right to cancel their account. By accessing, using, offering services, or performing any activity within MASQAR’s platform, USERS agree and guarantee they meet location and age restriction requirements.
USERS agree and guarantee to provide accurate information during the registration process and to timely update their information on their MASQAR account.
USERS are not allowed to share their MASQAR account with any third-parties, whether temporarily or permanently. All activities performed from a USER account are the responsibility of the USER, and the USER only.
USERS are not allowed to create multiple MASQAR accounts under the same type. A single person may have one (1) account as a CUSTOMER and one (1) as a TRANSLATOR.
USERS are in obligation to report any security breach that might compromise the confidentiality of their CUSTOMER INFORMATION AND DOCUMENT(S) and their login information. It is strictly forbidden to share access information with third-parties.
If you are entering into these Terms and Conditions, you represent that you are of the age of majority in your jurisdiction or place of residence. In case you misrepresent your age, your member registration will be canceled.
Additionally to these Terms and Conditions, USERS fully agree with the contents of our PRIVACY POLICY as a comprehensive provision. USERS agree to indemnify MASQAR, its directors, employees, partners, and affiliates in the event of any loss, damage, or expense, including legal expenditures to be incurred in the event of litigation.
USERS will not copy, modify, decompile, reverse-engineer, or create derived works out of their CUSTOMER INFORMATION AND DOCUMENT(S) without their consent unless it has been stipulated by the customer expressly.
Within the MASQAR platform, USERS warrant that they will not perform any of the following tasks: publish, communicate, display, store, forward, send, access, or promote content that may be deemed illegal, threatening, harmful, defamatory, abusive, violent, pornographic, sexually offensive, racist, invasive of another's privacy, and humiliating. Also, when the content represents an inconvenience or exposure to directors, employees, affiliates, shareholders, users, partners, or customers and potential customers of MASQAR and any of its business partners. MASQAR reserves the right to remove this content from the platform without having to notify the USERS.
MASQAR will not be liable for any consequence arising from the temporary o definitive loss or inaccessibility of the USERS accounts due to technical issues during the service.
MASQARS reserves the right to place third-party links on their website or app, and shall not be accountable for any issues derived from services provided by these third-parties.
MASQAR provides CUSTOMERS and TRANSLATORS a service of intermediation to fulfill CUSTOMERS localization and interpreting requirements with the services of TRANSLATORS registered in the platform.
CUSTOMERS and TRANSLATORS engage in business at their own risk, and shall be responsible to each other for the quality of their instructions and delivered documents or interpreting services. MASQAR provides no guarantees regarding their transactions or abilities. Nevertheless, decisions about the QUALITY LEVEL of the product delivered by the TRANSLATOR, or the QUALITY LEVEL of the instructions to perform the task given by the CUSTOMER, are solely determined by MASQAR, in which all decisions are final.
MASQAR is not in charge of the supervision of the quality of the content delivered by the TRANSLATOR or instructions given by the CUSTOMER related, but not limited to reliability, fluency, completeness, correctness, grammar, orthography, lawfulness, accuracy, or reasonable delivery times.
CUSTOMERS have a responsibility to share all necessary instructions accurately and timely to TRANSLATORS to complete the work with the highest possible quality. TRANSLATORS are deemed to use that information to provide the best possible service.
USERS accounts might be suspended without any notification for any of the following practices:
TRANSLATORS are welcome to use MASQAR’s platform to find customers and provide their services to them by paying a monthly fee. The value of such a fee is subject to change without notifications. However, MASQAR will make an effort to timely notify TRANSLATORS of any change in their pricing plans: Basic, Standard, Comfort, and Premium. CUSTOMERS are allowed to use the platform for free.
Payments for TRANSLATORS will be delivered in two ways; Via Online or Cash. Once the job is completed Online, the CUSTOMER's payment method will be debited, and the transfer of the funds will take place to the TRANSLATOR's account. If the job took place in person, the CUSTOMER shall pay the TRANSLATOR for their services.
In no case shall MASQAR be accounted for payments to TRANSLATORS promised or negotiated by CUSTOMERS.
USERS allow MASQAR to use their works as "public samples," granting a worldwide, irrevocable, royalty-free, and perpetual license to display, publish, and advertise any works in connection with promoting, improving, and operating our services.
Any content, copyrighted material, and any other proprietary information/content, trademarks on MASQAR’s platform, are exclusively owned by MASQAR. USERS shall not copy, publish, modify, broadcast, retransmit, display, distribute, sell, or reproduce or use MASQAR’s Platform content in any manner, without the specific content of MASQAR. The logos, service marks, and trademarks displayed on this site are owned by MASQAR and are protected by United Arab Emirates trademark laws. All of the other trademarks not owned by MASQAR and appearing on this site are properties of their respective owners, who might or might not be connected to, affiliated with, or sponsored by MASQAR. These might not be reproduced in part, or whole, without the written permission of the respective owner.
USERS agree that the translated documents and services and any economic rights on these (including the right to reproduce, adapt, perform, distribute and broadcast or communicate) shall be assigned to the respective CUSTOMER without limitations.
If USERS submit suggestions or feedback about MASQAR’s services, MASQAR might use their suggestions or feedback without obligation to them.
USERS hereby agree to hold harmless and indemnify MASQAR, its directors, employees, partners, and affiliates from and against actions like lawsuits, claims, damages, losses, costs (including eventual attorneys' fees) directly or indirectly caused by their use, misuse, inability to use MASQAR’s platform, and any other MASQAR rules and principles, laws or other legal rules and regulations whether by intention, negligence, or otherwise.
MASQAR including without limitation the respective principals, directors, corporate officers, employees, representatives, and agents make no warranties or representations, implied or express, about the accuracy, suitability, timeliness or any other feature of the site, content on MASQAR, or accessed via MASQAR for any purpose, all of which is provided "as available" and "as is" without any warranty of any type. In no event shall MASQAR, its principals, directors, corporate officers, employees, representatives, and agents be liable for any indirect, direct, special, incidental, consequential, exemplary or other damages in whatever form, without regard to any action of any kind, including but not limited to negligence, contract or any other tortious action, in connection with or arising out of the site, any content on or accessed via the site, or any display, copying or other use thereof.
MASQAR’s platform and its services and contents are provided "as is". USERS engage in the use of the indicated at their own risk and control. MASQAR gives no warranties of any kind, express or implied, against any kind of defects, seizures, third party ownerships, claims concerning the quality, accuracy, continuity, reliability, and accuracy of the platform at all times.
These Terms and Conditions are not to be inferred as forming a partnership, joint venture, job agency, employment, or any other similar relationships between USERS and MASQAR.
These Terms and Conditions have been construed following the laws of the United Arab Emirates. MASQAR and USERS consent the jurisdiction of Dubai Courts to host any disputes arising from the interpretation of these Terms and Conditions.
This agreement might only be amended with MASQAR’S express consent. Unless otherwise stated explicitly, the Terms and Conditions will survive the termination of all USERS membership to MASQAR services.
If it turns out that any provision, in particular, is held invalid, it will not affect the remainder of this Agreement.
